Terms & Conditions

1. IDENTIFICATION OF THE PARTIES
The Provider (The Platform): HC CORP SOLUTIONS S.A.C. (Honestia Connect Education), with RUC 20615076563 and registered address in Lima, Peru.
The User: Any natural or legal person who accesses, browses, registers or acquires access licenses to the platform's services, whether as a Student, Instructor, or Commercial partner.
2. SUBJECT MATTER OF THE CONTRACT
These General Terms of Use govern the acquisition and access to licenses for educational software, live courses, asynchronous (recorded) content, study materials and certification processes (hereinafter, "The Service") offered through the Honestia Connect technology platform.
3. ACCOUNTS, REGISTRATION AND SECURITY
- Legal Capacity: Registration is restricted to persons over 18 years of age with full legal capacity. Minors require the express supervision and authorization of their father, mother or legal guardian, who will assume joint liability for the minor's actions on the platform.
- Non-Transferability (Zero Tolerance): Your account is personal and non-transferable. It is strictly prohibited to transfer, rent, sell or share your access credentials with third parties. Our systems audit IP addresses and concurrent device fingerprints. Detection of shared accounts will result in immediate and permanent algorithmic blocking of the account, without right to refund or appeal.
- Moderation & Community Standards Policy: Honestia Connect Education reserves the right to remove any content and suspend access of users who breach community standards, engage in offensive language, harassment, or violate these terms. This measure is taken to protect the integrity of the educational environment and the safety of our educational community, and is a discretionary power of the platform in response to inappropriate conduct detected by our systems or validated reports.
4. NATURE OF THE SERVICE AND INSTRUCTOR LIABILITY
4.1. Informational Nature and Disclaimer of Results Warranties
The Platform does not guarantee financial, employment, health or any other results derived from applying the knowledge acquired. All content is strictly educational and informational in nature. Certificates issued accredit the completion of the curriculum and the technical approval of the platform's assessments, but do not constitute, under any jurisdiction, official university degrees or academic credentials accreditable by state entities (such as SUNEDU in Peru or equivalent Ministries of Education).
4.2. Agency Relationship (Partner Instructors) and Indemnity
Honestia Connect operates as an EdTech infrastructure (technology-as-a-service provider). Much of the educational catalog is designed and taught by Associate Instructors (Independent Third Parties). The opinions, advice, data and methodologies expressed in the courses are the sole responsibility of each Instructor.
Indemnity Clause: In the event that an Instructor disseminates defamatory information, infringes third-party copyrights, or issues advice that results in direct harm to a User, the User acknowledges that liability rests with the original issuer (the Instructor). However, the Platform maintains a strict Takedown policy and undertakes to audit, suspend or remove any Instructor who violates our internal quality regulations or applicable laws upon receipt of a formal complaint.
5. ECONOMIC CONDITIONS, PRICING AND TAXES
5.1. Transactions and Processing Errors
Payments are made through integrations with third-party payment processing infrastructures. In the event of processing errors, duplicate transactions or network outages during checkout, the User acknowledges that these failures are technical and beyond the direct control of HC CORP SOLUTIONS S.A.C. The Platform undertakes to assist the User by providing the necessary documentation (Transaction Logs) for the User to open the corresponding dispute channels with their bank or the processing gateway, but assumes no direct liability for funds temporarily held by financial institutions.
5.2. International Taxes and Withholdings
Prices displayed on Honestia Connect Education are presented at their net base value. Depending on the tax jurisdiction from which the User makes the transaction (for example, VAT in Peru, VAT in the European Union or other value-added taxes in Latin American countries), final prices may be increased during the payment process in accordance with mandatory local tax rates. The User is solely responsible for any sales or use tax applicable in their territory. Honestia Connect does not act as a withholding agent for income or wealth taxes of the User.
6. REFUND POLICY AND RIGHT OF WITHDRAWAL
To protect the intellectual property of our instructors and maintain a fair community, our refund policy is governed by the following strict conditions:
- Asynchronous (Recorded) Courses: We offer a refund guarantee within the first 7 calendar days from the date of purchase, strictly conditioned on the User NOT having engaged in abusive consumption of the digital product. Any refund request will be denied if the system detects that the user has:
1. Viewed or marked as completed more than 20% of the total course content (e.g., started session 2 of a 5-session course).
2. Downloaded any file, attachment or resource provided within the virtual classroom (PDFs, templates, code, audio files, etc.). - "Live" Courses or Cohorts: Since live classes require reserving a limited seat and planning on the part of the instructor, refunds will only be processed if requested at least 48 hours before the official start of the first live class. Once this deadline has passed, no refunds will be issued.
- System Abuse (Hit & Run): Honestia Connect reserves the right to ban accounts and deny refunds to users who demonstrate a pattern of systematic purchases and returns, regardless of their progress.
6.1. 1-on-1 Personalized Advisory & Session Packages
- Individual Session (1 appointment): Booking an individual session exclusively reserves the specialist's schedule slot. Cancellations or rescheduling requests are only valid with at least 48 hours advance notice. Once this period has passed or in the event of student no-show, the session is deemed rendered/completed without refund entitlement.
- Multi-Session Packages (3 & 5 Sessions): When purchasing a package, the Student schedules their first appointment during the checkout flow. Remaining unused sessions are credited to their account balance in their virtual classroom to be scheduled at their convenience based on specialist availability.
- Expiration Period of Unused Sessions: To ensure specialist calendar predictability and operational sustainability, multi-session packages carry a strict, non-extendable validity period starting from the payment date:
— 3-Session Package: Maximum validity of 60 calendar days.
— 5-Session Package: Maximum validity of 90 calendar days.
Upon expiry of this period without scheduling pending sessions, such sessions automatically lapse with no right to refunds, indemnification, credit, or subsequent reactivation. - Continuity Guarantee / Specialist Unavailability: Should the specialist temporarily suspend availability or enter a recess period, the validity day count freezes automatically for the exact number of days during which no booking slots are available.
7. INTELLECTUAL PROPERTY AND LICENSING
Platform Rights: The software architecture, source code, AI algorithms, user interfaces (UI), registered trademark "Honestia Connect", logos and databases are the exclusive and inalienable industrial property of HC CORP SOLUTIONS S.A.C.
Instructor Rights (Content): Instructors retain the intellectual property of their scripts, videos and methodologies uploaded to the platform. By publishing a course, the Instructor grants HC CORP SOLUTIONS S.A.C. a global, perpetual, transferable, sublicensable and royalty-free license to host, reproduce, distribute, modify (for technical reasons such as video compression) and commercialize such content.
Student License: Payment for a course grants the Student a revocable, limited, non-exclusive and non-transferable license to access and view the content solely for personal and educational use. Screen recording, unauthorized downloading, retransmission (piracy) or use of the material to train Artificial Intelligence models (AI scraping) outside the Platform is prohibited by law (and will result in civil and criminal legal action).
8. LIMITATION OF LIABILITY (CAP OF LIABILITY)
To the fullest extent permitted by applicable law (including the Consumer Protection and Defense Code of Peru), in no event shall the total cumulative liability of HC CORP SOLUTIONS S.A.C., its directors, employees, affiliates or suppliers to the User for all damages, losses, lost profits and causes of action (whether in contract, tort or negligence) exceed the total amount that the User has actually paid to the platform in the last twelve (12) months immediately preceding the event that gave rise to the claim. We will not be liable for indirect, incidental, punitive or consequential damages arising from the use of our technology.
9. APPLICABLE LAW AND DISPUTE RESOLUTION
These terms are governed entirely by the laws of the Republic of Peru. For the resolution of any dispute arising from the interpretation or execution of this contract, the parties submit to the jurisdiction of the Judges and Courts of Justice of the consumer's domicile in Peru, in accordance with the law. Alternatively, the consumer may choose to submit the dispute to the conciliation or arbitration mechanisms of the Lima Chamber of Commerce or INDECOPI.
